Abstract
Shipping is part of sea transportation. Shipping is controlled by the state and its guidance is carried out by the government. The importance of safety and security issues in shipping is the responsibility of the harbormaster. The purpose of this study is to analyze the regulation of shipping in positive law in Indonesia and the authority of the porter based on the Law of the Republic of Indonesia Number 17 of 2008 concerning Shipping in creating shipping safety and security. The results of the research show that the Law of the Republic of Indonesia Number 17 of 2008 concerning Shipping basically contains provisions regarding various aspects of shipping. The law regulates matters in which there are important factors of transportation in waters and provides guarantees for shipping in Indonesian waters. Syahbandar in carrying out the functions and duties of shipping safety is regulated in the Law of the Republic of Indonesia Number 17 of 2008 concerning Shipping. The harbormaster carries out the function of shipping safety and security which includes the implementation, supervision, and law enforcement in the field of transportation in waters, ports, and the protection of the maritime environment in ports
