Abstract

The examination entitled The Presence of Capital punishment in Indonesia after the endorsement of Regulation Number 1 of 2023 concerning the Crook Code raises the detailing of the issue to be explored, namely How the Existence of the Death Penalty Post Law Number 1 of 2023 concerning the Code of Laws Crime and How to Reform the Death Penalty as a special punishment for certain criminal acts applied in Indonesia. This research uses a normative type of research, using secondary data, namely data obtained directly through library materials through documentation studies, which consist of primary legal materials. The existence of the death penalty in Indonesian positive law is still maintained, this can be seen from various legal provisions (the Criminal Code and other statutory regulations), the imposition of the death penalty according to the sentences in the Criminal Code, is always an alternative to other types of punishment. Law Number 1 of 2023 concerning the Criminal Code, Articles 64 and 67 regulate the death penalty in the form of a special punishment for certain criminal acts specified in the law which is a crime that always carries an alternative threat.
