Abstract
This paper examines the protection of data property rights and the balance of interests among stakeholders in the context of China's rapidly growing digital economy. It analyzes the theoretical foundations of data rights, including their intangible, non-exclusive, and scalable characteristics, and discusses the legal and economic attributes of data as a new factor of production. The study highlights the conflicts between personal interests (e.g., privacy and autonomy) and property interests (e.g., value creation and distribution) involved in data processing, circulation, and use. By exploring the rights and responsibilities of data subjects, holders, and users, the research proposes strategies such as clarifying data ownership under the "Tripartite Rights Separation" framework, improving data transaction mechanisms, and strengthening anti-monopoly regulations to promote equitable interest distribution and efficient data utilization. The paper also evaluates regional practices in developed provinces and identifies gaps in Fujian's current data property rights system, offering policy recommendations to enhance institutional construction and regional coordination.
