Abstract
Under the “dual carbon” goals, green electricity is core to cross-Strait energy optimization, and its data sharing is key to power grid interconnection. However, sharing faces three dilemmas: ambiguous property rights, cross-border barriers, and lack of security/profit mechanisms, with cooperation hindered by property disputes and unrecognized standards.Following “dilemma - right confirmation – protection” logic, this paper combines the “Twenty Measures on Data” and cross-Strait energy characteristics to build a green electricity data property definition and legal protection system. For property rights: original data ownership follows “collector priority + joint ownership”, derived data use right adheres to “processor dominance + original holder notification”; cross-border circulation relies on hierarchical authorization and green certificate confirmation. For legal protection, a “soft law priority + hard law connection + mechanism guarantee” system is adopted, including formulating cooperation guidelines, establishing self-regulation mechanisms, improving cross-border laws, building conflict coordination paths, setting up property trading platforms, forming security assessment teams, and clarifying profit distribution. The research shows clear property rights and sound laws can drive green electricity data from “closed” to “open”, support Fujian-Taiwan grid interconnection and cross-Strait wind power development, and boost energy integration.
